STANDING RULES

 

Every local PTA/PTSA unit and council should have standing rules to serve as guidelines. Ben Franklin PTA standing rules should be used in conjunction, but not in conflict, with the uniform bylaws under which all local units and councils in Washington State operate.

 

1.        The name of this unit shall be Ben Franklin PTA #2.8.15.

2.        This unit is a non-profit corporation recognized by the State of Washington on November 1, 1977 and amended on January 1, 1988. It is the responsibility of this unit to annually renew the Articles of Incorporation prior to March 1. The incorporation number was 1279662 and the amended number is 2-279662-7.

3.        This unit’s employer is located on 12434 NE 60th Street, Kirkland, WA 98033.

4.        This unit was recognized by the IRS as a non-profit tax exempt organization on April 21, 1986, under Section 501(c)(4). Amended June 15, 1998 to become an organization qualifying for tax exempt status under Section 501(c)(3).

5.        This PTA is registered under the Charitable Solicitations Act, registration number 429. The treasurer is responsible for filing the annual registration (must be filed by May 31st to avoid penalties).

6.        The treasurer is responsible for filing IRS Form 990 or Form 990 EZ or Form 990-N prior to November 15th and showing a copy to the board by November 1st.

7.        The Executive Committee of this unit shall be the President(s), Vice President(s), Secretary, Scrip Treasurer, and PTA Treasurer. The Principal shall serve as an advisor.

8.        Legal documents for this unit will be kept by the Treasurer and a copy will be kept in the PTA room.

9.        As of the 2010-2011 school year, the fees will be raised to a minimum of $12.00 for an individual membership and a minimum of $18.00 for a family membership.

10.     As of the 2010-2011 school year the State PTA membership fee will be $5.50, and in 2011-2012 the State PTA membership fee will be $5.75. The National PTA per capita assessment is currently $1.75, and the Council per capita assessment is $1.00. Increases to the State PTA’s service fees shall be determined by the State PTA convention. Bylaws Article IV, Section 4(a).

11.     The students of Ben Franklin Elementary School shall be considered honorary members of this unit without voice, vote or privilege of holding office.

12.     The Nominating Committee shall be elected according to the Bylaws, Article V.

13.     The Board of Directors shall consist of all elected officers: The President(s), Secretary, Scrip Treasurer, Treasurer, Vice President(s) of Fundraising, Vice President(s) of Education/Enrichment, Vice President(s) of Communications, Vice President(s) of Health and Welfare, Vice President(s) of Special Events, and Legislative Chairperson. The Principal and the Teacher Representative(s) shall serve as advisors. Board meetings of this unit shall be posted and will usually be held at 7:00 P.M. in the Ben Franklin Library.

14.     General Membership Meetings of this unit shall usually be held on a Thursday. There shall be at least three (3) General Meetings during the year.

15.     An Office/Chairpersonship shall be declared vacant if that person misses three (3) consecutive Board of Directors Meetings unless excused by the President. Bylaws Article VII, Section 1(d).

16.     Golden Acorn Award(s) shall be given. A committee appointed by the president(s) shall select the recipient(s).

18.     Voting delegates to the Lake Washington PTSA Council shall be a President and three (3) authorized delegates. See Article IV, Section 1 in the bylaws.

19.     The vote for this unit for the Region 2 Director shall be by Board action.

20.     Voting delegate(s) to the annual State PTA Convention shall be a PTA President and another PTA member determined by the board of directors. See Article XII, Section 2(b) in the bylaws.

21.     Voting delegate(s) to the Legislative Assembly shall be the Legislative Chairperson, unless otherwise designated by the Board.

22.     The standing rules shall be adopted annually by a majority vote at the first General Membership Meeting.

23.     Standing rules can be amended at any General Membership Meeting. If the members are properly notified ahead of time that a change is being proposed and what the change is, then adoption of the change requires only a majority vote. If the members are not properly notified ahead of time, then the adoption of the change requires a 2/3 vote.

24.     This PTA shall approve its annual operating budget at the General Membership Meeting in the spring of each year.

25.     The quorum for General Membership Meetings shall be 10. As per Bylaws Article XI, Section 1(c).

26.     The Treasurer’s and Scrip Treasurer’s records shall be audited yearly in July.

27.     Each board position that is held jointly by two people has one vote.

28.     Members may attend meetings remotely by video or telephone conferencing technology. All persons, whether physically at the meeting or “in attendance” remotely by video or telephone conferencing technology, must be able to hear each other at all times. This is intended to accommodate members who may be out of town at the time of an important meeting, not as a regular, widespread method of conducting or attending meetings. Members participating remotely are considered present at the meeting for purposes of quorum, debate, voting, etc.
